Frequently Asked Questions
Can I sue Amazon / Flipkart directly even if the seller is a third party? +
Yes — e-commerce platforms are 'service providers' under CPA 2019. They can be made an opposite party for facilitating defective transactions. The Consumer Protection (E-commerce) Rules 2020 also impose obligations on platforms.
What if the product was from an international seller? +
If you paid on an Indian platform and received delivery in India, you can file against the Indian platform entity (Amazon Seller Services Pvt Ltd / Flipkart Internet Pvt Ltd). International seller jurisdiction is complex.
How do I prove the product was defective? +
Unboxing video is the strongest evidence. Photographs, email/chat acknowledgements from the platform, and independent assessment reports also help.
Can I file for a ₹500 product? +
Yes — there is no minimum claim value under CPA 2019. DCDRC fee for claims up to ₹5 lakh is only ₹200.
