Niche Issues Specific to Major Appliances
Compressor / Extended Component Warranty
Refrigerators and ACs are typically sold with a shorter general warranty (often 1 year) but a much longer compressor warranty (commonly 5–10 years, per the manufacturer's own terms). A compressor failure within that extended period, refused without valid cause, is measured against the manufacturer's own specific published terms — not the shorter general warranty period.
Installation Damage
Where the brand mandates installation by its own authorised technician (common for split ACs) and that installation is done negligently — causing gas leakage, water leakage, or unit damage — the brand/installer is liable for that installation deficiency, separate from any manufacturing defect in the unit itself.
Refrigerant/Gas Leakage
Recurring gas leakage shortly after purchase or repair, where not attributable to external damage, points to a manufacturing or installation defect rather than normal wear.
BEE Star Rating Mismatch
Appliances sold in India are required to display the Bureau of Energy Efficiency (BEE) star label reflecting standardised, BEE-tested energy consumption. An appliance that consumes materially more power than its labelled star rating indicates, verified through actual usage/testing, raises a distinct misrepresentation claim under Section 2(47) (unfair trade practice), separate from any mechanical defect.
Doorstep Service Delay
Most brands publish a service-response time commitment (e.g. technician visit within 24–48 hours in serviceable areas). Repeated failure to meet the brand's own published service commitment, causing prolonged loss of use of an essential appliance, is a deficiency in after-sales service.
Applicable Law
A manufacturing fault is a "defect" under Section 2(10), CPA 2019; a shortfall in installation, repair, or service-response commitments is "deficiency" under Section 2(11); and a false energy-rating or performance claim is "unfair trade practice" under Section 2(47). The manufacturer, the authorised service franchisee, and the retailer can each be liable depending on which of them caused the specific failure, and more than one can be joined as opposite parties.
Jurisdiction & Forum
| Forum | Pecuniary jurisdiction | Location |
|---|---|---|
| DCDRC Puducherry | Value of goods/services paid as consideration up to ₹50 Lakh | Lawspet, Puducherry |
| SCDRC Puducherry | ₹50 Lakh to ₹2 Crore; also first appeals from DCDRC orders | Lawspet, Puducherry |
| NCDRC | Above ₹2 Crore; also first appeals from SCDRC orders | New Delhi |
(Section 34(1)/47(1)(a)(i)/58(1)(a)(i) of the Act itself set these thresholds at ₹1 Crore / ₹10 Crore / above ₹10 Crore; each carries a proviso letting the Central Government prescribe a different value. Exercising that power, the Consumer Protection (Jurisdiction of the District Commission, the State Commission and the National Commission) Rules, 2021 currently set the values shown in the table above.) Under Section 34(2), a Puducherry buyer may generally file at DCDRC Puducherry where they reside.
Limitation Period
Under Section 69, CPA 2019, a complaint must ordinarily be filed within two years from the date the cause of action arose — the date a within-warranty claim was refused, or the date service delay became unreasonable.
Documents Typically Needed
- Purchase invoice and the manufacturer's warranty card (noting the separate compressor/component warranty period, if any)
- Installation report/certificate, where installation is disputed
- Service/job-sheet history and any technician's diagnostic notes
- Photographs/video of the defect, leakage, or damage
- The appliance's BEE label and, if disputed, any independent power-consumption test record
- Correspondence with the brand's customer care/nodal officer
General Process Outline
- Step 1 — Written complaint: Raise the issue in writing with the service centre/franchisee and the brand's customer care/nodal officer, referencing the specific warranty term applicable.
- Step 2 — Legal notice: A written notice to the brand/retailer/installer as relevant, setting out the defect and relief sought.
- Step 3 — File the complaint: Under Section 35, with supporting documents and affidavit, at DCDRC Puducherry, online via e-jagriti.gov.in or in person.
- Step 4 — Admission and hearing: Per Section 36 (admission, ordinarily within 21 days of filing) and Section 38 (notice to the opposite party within 21 days of admission; response within 30 days, extendable by 15 days), then hearing and evidence, including expert evidence where the cause of a compressor or gas-leak defect is disputed.
- Step 5 — Order: Under Section 39, the Commission may direct relief it considers appropriate on the facts proved — repair, replacement, refund, or compensation; the Act does not fix or guarantee any specific outcome.
- Step 6 — Appeal: An order of DCDRC may be appealed to SCDRC Puducherry under Section 41 within 45 days of the order (condonable for sufficient cause); an appellant required to pay any amount under the order must first deposit 50% of that amount.
