Common Grievances
- Warranty denied on a disputed pretext: "Liquid damage" or "physical damage" cited without a proper inspection report to deny an in-warranty repair.
- Recurring hardware faults: Motherboard, display, keyboard, or battery issues that recur despite repeated repairs.
- Repair delay: The device held at the service centre well beyond the brand's own committed turnaround time, without an update or loaner device.
- Data loss: Data lost during a repair without prior warning/consent, where a backup was possible before the repair began.
- Non-genuine parts: Non-OEM parts used in a warranty or paid repair.
- On-site/premium-support entitlement denied: Refusal to honour a paid on-site or accidental-damage-protection (ADP) plan the buyer separately purchased at sale.
Applicable Law
A manufacturing fault is a "defect" under Section 2(10), CPA 2019; a shortfall in warranty honouring or repair turnaround is "deficiency" under Section 2(11); and misrepresenting a paid protection plan's coverage at the time of sale is "unfair trade practice" under Section 2(47). Both the brand/manufacturer and the retailer/seller can generally be joined as opposite parties, and where a separately purchased extended warranty/ADP plan is involved, the plan provider (which may be a third party, not the laptop manufacturer) can also be a relevant opposite party — see the separate Extended Warranty Denial page for disputes specifically about a paid third-party plan.

(Section 34(1)/47(1)(a)(i)/58(1)(a)(i) of the Act itself set these thresholds at ₹1 Crore / ₹10 Crore / above ₹10 Crore; each carries a proviso letting the Central Government prescribe a different value. Exercising that power, the Consumer Protection (Jurisdiction of the District Commission, the State Commission and the National Commission) Rules, 2021 currently set the values shown in the table above.) Almost all laptop complaints fall within DCDRC Puducherry's jurisdiction by value.
Limitation Period
Under Section 69, CPA 2019, a complaint must ordinarily be filed within two years from the date the cause of action arose — the date the warranty claim was refused, or the date repair delay became unreasonable.
Documents Typically Needed
- Purchase invoice and the manufacturer's warranty terms (and any separately purchased ADP/extended plan terms)
- Service centre job sheet(s) and any inspection/diagnostic report issued
- Photographs/video of the defect, and of the device's condition at drop-off
- Correspondence with the brand's customer care/nodal officer
- Proof of data on the device prior to repair, if a data-loss claim is made
General Process Outline
- Step 1 — Written complaint: Raise the issue in writing with the service centre and the brand's customer care/nodal officer, retaining the job sheet and all correspondence.
- Step 2 — Legal notice: A written notice to the brand and/or seller setting out the defect and relief sought.
- Step 3 — File the complaint: Under Section 35, with supporting documents, at DCDRC Puducherry, online via e-jagriti.gov.in or in person; it is heard on the basis of an affidavit and documentary evidence (Section 38(6)).
- Step 4 — Admission and hearing: Per Section 36 (admission, ordinarily within 21 days of filing) and Section 38 (notice to the opposite party within 21 days of admission; response within 30 days, extendable by 15 days), then hearing and evidence.
- Step 5 — Order: Under Section 39, the Commission may direct relief it considers appropriate on the facts proved — repair, replacement, refund, or compensation; the Act does not fix or guarantee any specific outcome.
