Shop Charging Above MRP in Pondicherry? File a Consumer Complaint at DCDRC

✍️ Advocate📅 January 2025⏱ 7 min read📍 Pondicherry / Puducherry

Hotels, restaurants, cinema halls, and ordinary shops in Pondicherry routinely charge above Maximum Retail Price (MRP) for water bottles, beverages, and packaged snacks. This is illegal — and you can get a refund plus compensation. Advocate specialises in MRP violation consumer complaints at DCDRC Puducherry and CCPA enforcement actions.

MRP Law in India — The Legal Metrology Act 2009

The Maximum Retail Price (MRP) system in India is governed by the Legal Metrology Act 2009 and the Legal Metrology (Packaged Commodities) Rules 2011. Under these laws, every pre-packaged commodity sold in India must carry a printed MRP — and that MRP is inclusive of all taxes. No seller anywhere in India can legally charge more than the printed MRP for a packaged product. This applies without exception: hotels, restaurants, airports, stadiums, cinema halls, tourist shops, convenience stores, and vending machines are all bound by the same MRP ceiling.

Section 36 of the Legal Metrology Act 2009 makes it a criminal offence to sell any packaged commodity at a price exceeding the printed MRP. A first conviction carries a fine of up to ₹25,000; subsequent offences carry fines up to ₹50,000 or imprisonment. The Consumer Protection Act 2019 separately classifies selling above MRP as an "unfair trade practice," giving the consumer the right to compensation at DCDRC Pondicherry.

Who Sets MRP — And Why Retailers Cannot Change It

The MRP is determined and printed by the manufacturer or importer at the time of packaging. It is set to cover all costs including manufacturing, marketing, distribution, and GST. The retailer pays a wholesale price that is lower than the MRP and earns a margin — they are not permitted to add further to the MRP or claim that their costs are higher. The entire MRP system is designed specifically to protect the consumer from price exploitation at the point of sale.

There is no "tourist area exception," no "high rent area exception," and no "premium service exception" to the MRP rule. A water bottle with MRP ₹20 must be sold at ₹20 whether it is in a shop in Pondicherry Bazaar or in a five-star hotel in Heritage Town. The law does not recognise any justification for charging above the printed MRP.

Water Bottles at Hotels and Restaurants: The most common MRP violation in Pondicherry's tourist-heavy Heritage Town, White Town, and Promenade Beach area is hotels and restaurants charging ₹50-₹80 for packaged water bottles with an MRP of ₹15-₹20. This is plainly illegal. Ask for an itemised bill. If the bill shows a price above MRP, photograph both the bill and the MRP on the product — you have a complete consumer complaint. Courts have awarded refunds of the excess, compensation, and litigation costs in such cases.

Service Charge at Restaurants — Is It Legal?

One of the most frequently asked questions by consumers in Pondicherry is whether restaurants can compulsorily charge a "service charge." The CCPA issued clear guidelines in July 2022, upheld by the Supreme Court of India, stating that service charge in restaurants is entirely voluntary — it is not a tax or a legal requirement. Restaurants cannot: add service charge to the bill without clearly informing customers that it is optional; refuse to waive it when the customer objects; or deny entry or service to customers who refuse to pay service charge. Any Pondicherry restaurant that compulsorily levies service charge is violating CCPA guidelines and the Consumer Protection Act 2019.

MRP Violations at Cinema Halls and Multiplexes

Cinema halls and multiplexes in Pondicherry charge inflated prices for food and beverages sold inside the theatre. While the question of whether cinemas can prohibit outside food is still being litigated, the clear rule on MRP remains unchanged: any packaged product sold inside a cinema — a water bottle, a packet of popcorn, a chocolate bar — must not exceed its printed MRP. Charging above MRP for a packaged product inside a cinema hall is an MRP violation actionable at DCDRC Puducherry and before the CCPA.

How to Complain About MRP Violations Effectively: (1) Always obtain and keep the itemised bill showing the amount charged. (2) Photograph the product clearly showing its printed MRP. (3) These two pieces of evidence establish the violation definitively. (4) Report to CCPA via the National Consumer Helpline (1800-11-4000) or consumerhelpline.gov.in for regulatory action against the establishment. (5) File at DCDRC Puducherry for your personal refund and compensation. Both steps together create maximum pressure on the habitual MRP violator.

CCPA Penalty on MRP Violators

The CCPA has powers under the Consumer Protection Act 2019 to investigate and penalise businesses engaged in systematic MRP violations. CCPA actions can result in: financial penalties running into lakhs of rupees; public naming and shaming of violating establishments; orders to display correct pricing; and in serious cases, criminal prosecution under the Legal Metrology Act. Consumer complaints to the CCPA are particularly effective when they are coordinated (multiple consumers from the same establishment), as they demonstrate systematic, not one-off, violations.

Filing Your MRP Violation Complaint at DCDRC Pondicherry

File your consumer complaint at the District Consumer Disputes Redressal Commission, Pondicherry (Lawspet, Puducherry) or online at the e-Jagriti portal (e-jagriti.gov.in). The complaint must be filed within 2 years of the overcharge. Claim: the excess amount paid above MRP (however small); compensation for the unfair treatment and mental harassment; and the cost of litigation. Even small-value MRP violations are worth pursuing for the principle and for the deterrent effect. Courts have been consistently sympathetic to MRP overcharge cases.

No Amount is Too Small: Consumer courts in India have repeatedly held that no consumer overcharge is too small to warrant a complaint. The principle at stake — that sellers must not exploit consumers — is important regardless of the rupee amount. Many DCDRC cases on MRP violations involve ₹30-₹50 overcharges, and courts have awarded ₹5,000-₹10,000 in compensation for the principle of the matter. Contact Advocate for guidance on whether your case is worth pursuing.
