MRP Law in India — The Legal Metrology Act 2009
The Maximum Retail Price (MRP) system in India is governed by the Legal Metrology Act 2009 and the Legal Metrology (Packaged Commodities) Rules 2011. Under these laws, every pre-packaged commodity sold in India must carry a printed MRP — and that MRP is inclusive of all taxes. No seller anywhere in India can legally charge more than the printed MRP for a packaged product. This applies without exception: hotels, restaurants, airports, stadiums, cinema halls, tourist shops, convenience stores, and vending machines are all bound by the same MRP ceiling.
Section 36 of the Legal Metrology Act 2009 makes it a criminal offence to sell any packaged commodity at a price exceeding the printed MRP. A first conviction carries a fine of up to ₹25,000; subsequent offences carry fines up to ₹50,000 or imprisonment. The Consumer Protection Act 2019 separately classifies selling above MRP as an "unfair trade practice," giving the consumer the right to compensation at DCDRC Pondicherry.

Who Sets MRP — And Why Retailers Cannot Change It
The MRP is determined and printed by the manufacturer or importer at the time of packaging. It is set to cover all costs including manufacturing, marketing, distribution, and GST. The retailer pays a wholesale price that is lower than the MRP and earns a margin — they are not permitted to add further to the MRP or claim that their costs are higher. The entire MRP system is designed specifically to protect the consumer from price exploitation at the point of sale.
There is no "tourist area exception," no "high rent area exception," and no "premium service exception" to the MRP rule. A water bottle with MRP ₹20 must be sold at ₹20 whether it is in a shop in Pondicherry Bazaar or in a five-star hotel in Heritage Town. The law does not recognise any justification for charging above the printed MRP.
Service Charge at Restaurants — Is It Legal?
One of the most frequently asked questions by consumers in Pondicherry is whether restaurants can compulsorily charge a "service charge." The CCPA issued clear guidelines in July 2022, upheld by the Supreme Court of India, stating that service charge in restaurants is entirely voluntary — it is not a tax or a legal requirement. Restaurants cannot: add service charge to the bill without clearly informing customers that it is optional; refuse to waive it when the customer objects; or deny entry or service to customers who refuse to pay service charge. Any Pondicherry restaurant that compulsorily levies service charge is violating CCPA guidelines and the Consumer Protection Act 2019.
MRP Violations at Cinema Halls and Multiplexes
Cinema halls and multiplexes in Pondicherry charge inflated prices for food and beverages sold inside the theatre. While the question of whether cinemas can prohibit outside food is still being litigated, the clear rule on MRP remains unchanged: any packaged product sold inside a cinema — a water bottle, a packet of popcorn, a chocolate bar — must not exceed its printed MRP. Charging above MRP for a packaged product inside a cinema hall is an MRP violation actionable at DCDRC Puducherry and before the CCPA.
CCPA Penalty on MRP Violators
The CCPA has powers under the Consumer Protection Act 2019 to investigate and penalise businesses engaged in systematic MRP violations. CCPA actions can result in: financial penalties running into lakhs of rupees; public naming and shaming of violating establishments; orders to display correct pricing; and in serious cases, criminal prosecution under the Legal Metrology Act. Consumer complaints to the CCPA are particularly effective when they are coordinated (multiple consumers from the same establishment), as they demonstrate systematic, not one-off, violations.
