Substandard Quality Product — How to File Consumer Complaint at Pondicherry DCDRC

✍️ Advocate📅 January 2025⏱ 7 min read📍 Pondicherry / Puducherry

Bought a product in Pondicherry that broke within days, failed to perform as advertised, or turned out to be far inferior to what was shown on the packaging? Substandard quality is a clear deficiency that entitles you to a refund, replacement, and compensation at DCDRC Puducherry. Advocate has successfully represented consumers in product quality disputes for over 10 years.

What Counts as a Substandard Quality Product?

Under the Consumer Protection Act 2019, a product is considered defective — and the seller/manufacturer is liable — when it suffers from any fault, imperfection, or shortcoming in quality, quantity, potency, purity, or standard, as required by law or as the seller expressly or impliedly represents. In plain terms, if what you receive does not match what was promised — whether on the label, in the advertisement, or by the seller at the time of sale — you have a valid consumer complaint.

Substandard quality products in the FMCG category include: cosmetics causing skin rashes or chemical burns contrary to the "dermatologically tested" claim; mineral water bottled below BIS standards with contamination; household cleaning agents that are far weaker than the stated concentration; packaged food products that are spoiled or of inferior quality despite a valid date; and baby or children's products made from materials that do not meet safety standards.

ISI and BIS Marks — What They Mean for Consumers

The Bureau of Indian Standards (BIS) is the national standards body of India. Products bearing the ISI mark (for most industrial and consumer products) or the BIS Hallmark (for gold jewellery) have been certified as meeting the minimum quality standards defined in the relevant Indian Standard. A product that carries an ISI/BIS mark but does not actually conform to that standard is not only a consumer rights violation but also a criminal offence under the BIS Act 2016.

When you buy a product with an ISI mark in Pondicherry and it fails to meet the standard — whether a packaged drinking water bottle that is contaminated, or a safety helmet that shatters under minor impact — you can file a complaint with BIS (at bispurewater.com or through their grievance portal) as well as a consumer complaint at DCDRC Puducherry for compensation. BIS can initiate criminal prosecution against the manufacturer, in addition to your civil remedy.

How to Check if a Product Meets BIS Standards: Many BIS-certified products can be verified on the BIS Care app or website by entering the licence number printed on the packaging. If the licence is invalid, expired, or doesn't match the product, that itself is evidence of a substandard or counterfeit product. Screenshot the failed verification and include it in your consumer complaint.

Manufacturer vs Retailer Liability

A frequently asked question in product quality disputes is: can I sue the retailer, or only the manufacturer? Under the Consumer Protection Act 2019, both the manufacturer and the seller can be made opposite parties in the same consumer complaint. The retailer who sold you the substandard product in Pondicherry is liable along with the manufacturer — particularly where the retailer made specific representations about the quality of the product. This makes it much easier for consumers to file locally, naming the Pondicherry-based retailer along with the distant manufacturer.

Product liability under the Consumer Protection Act 2019 (Chapter VI) also allows for a "strict liability" approach — meaning you do not need to prove negligence. You only need to show that the product was defective and that the defect caused you harm. This is a powerful provision that has significantly strengthened product quality complaints in India.

Defective Cosmetics Causing Skin Harm: Cosmetics sold in Pondicherry that cause skin rashes, chemical burns, or allergic reactions give rise to a particularly strong consumer case, especially where the product claimed to be "dermatologically tested" or "hypoallergenic." Preserve the product, photograph the skin reaction, obtain a dermatologist's report linking the reaction to the specific product, and keep your purchase bill. This is sufficient to file a strong product liability claim at DCDRC Pondicherry.

Claiming Refund and Compensation at DCDRC

For substandard quality complaints at DCDRC Pondicherry, the range of relief available includes: full refund of the purchase price; replacement with a conforming product; compensation for any harm caused by the defective product (medical bills, damage to property); compensation for mental harassment; and the cost of legal proceedings. Where the defect was known to the manufacturer or seller, punitive damages can also be sought.

DCDRC Pondicherry has jurisdiction to hear complaints where the compensation claimed is up to ₹50 lakhs. Most product quality complaints will fall well within this limit. Cases above ₹50 lakhs go to the State Consumer Disputes Redressal Commission (SCDRC) at Chennai/Pondicherry, where Advocate also appears.

Preserving Evidence for Product Quality Claims: Keep the defective product sealed (do not attempt to repair it yourself). Keep the original packaging, bill, and any warranty card. Photograph the defect clearly. If the product caused physical harm (a chemical burn from a cosmetic, for example), photograph the injury and get a medical report. If you tested the product and it failed (a water purifier that did not filter contaminants, for example), document the test with photographs or a third-party lab report.
